23/03/2026 Formal defects, an antidote to mortgage enforcement proceedings

We often make the mistake of assuming that when our legal opponent is a major organisation or institution, they do not make mistakes. That is not always the case, particularly in documentary matters.

Reverter Estudi Jurídic secured an important victory in enforcement proceedings based on an invalid title. In this case, a debt exceeding €130,000, plus interest and costs, was being claimed, but the Court of First Instance No. 1 of Reus fully upheld the opposition filed by the defence and set aside the enforcement, lifting all attachments and guarantees that had been imposed.

The ruling highlights a key principle: a mortgage cannot be enforced without a valid title. The court concluded that the enforcing party had failed to comply with the formal requirements established by law, thereby preventing an unjust enforcement action.

16/02/2026 It is not enough to defeat the bank in court; court rulings must also be enforced

Reverter Estudi Jurídic achieved another victory in defence of its clients’ rights against a banking institution by successfully pursuing the enforcement of a final ruling for approximately €20,000 in legal costs arising from a previous mortgage proceeding.

The Court of First Instance No. 4 of Tarragona fully upheld the enforcement claim and ordered payment of the amount due, together with interest and costs, thereby recognising the client’s right to make effective what had already been judicially declared.

This ruling reinforces an essential principle: judicial decisions must not only be favourable, but also effective.

22/01/2026 Unfair Social Security debts can be challenged

Reverter Estudi Jurídic obtained a significant court victory in a case with strong social impact: the criminalisation of situations of business insolvency where no genuinely fraudulent conduct existed.

In an actual proceeding, the Public Prosecutor’s Office and the Social Security authorities were seeking very severe penalties — up to five years’ imprisonment and fines amounting to hundreds of thousands of euros — for an alleged offence against the Social Security system arising from a debt exceeding €240,000.

However, the Provincial Court of Tarragona concluded that there had been no fraudulent conduct, but rather a difficult economic situation without concealment or deceit, and acquitted all the defendants and the companies involved.

21/01/2026 A step forward against fraudulent incorrect estimated electricity meter readings

Reverter Estudi Jurídic secured a court victory against the fraudulent practice of claiming estimated electricity readings where there had been a clear billing error.

In this case, our client was being asked to pay nearly €6,000, but the judgment of the Court of First Instance No. 4 of Reus ruled in favour of the defendant and ultimately held that only the actual consumption had to be paid, which was less than €2,000.
